The BSD license has certainly been tested in Court. It stood up to
AT&T, USL Novell. It has stood up to others:

The GPL has also been tested:
GPL tested in German court:

GPL tested in Michigan Court

Most of the time GPL cases don't make to Court because the infringing
side has given up after consulting attorneys. They usually settle long
before the case gets to Court.
